1. Introduction

Welcome to Australian Rewards Club (referred to as "ARC", "we", "us", or "our"). By accessing or using our website, services, or purchasing a membership, you agree to be bound by these Terms and Conditions ("Terms"). Please read them carefully.

2. Eligibility

To become a member of ARC, you must:

  • Be at least 18 years old.
  • Be a legal resident of Australia.
  • Agree to comply with these Terms and all applicable laws and regulations.

Exclusions:

This offer is available to residents of all Australian states and territories excluding the Australian Capital Territory (ACT) and South Australia (SA), due to applicable permit restrictions. It is the sole responsibility of the customer to consult their respective state or territory's eligibility requirements prior to making a purchase. By proceeding with a purchase, the customer acknowledges that they have read, understood, and accepted these terms, and confirms their eligibility to participate.

3. Membership

ARC offers two types of memberships:

    a. One-Time Packages:

    • Provide access to the ARC platform for a limited period.
    • Ideal for short term engagement.
    • May include entries into specific promotions, as detailed at the time of purchase.

    b. Member Packages:

    Note: If you sign up to a membership package, "per giveaway" means per month, as we only run one giveaway per calendar month.

    • Available in Silver, Gold, and Platinum tiers.
    • Offer continuous access to the ARC platform.
    • Include benefits such as bonus entries into giveaways, discounts, and exclusive deals.
    • Details of each tier, including pricing and benefits, are available on our website.

    4. Membership Fees and Billing

    • Membership fees are outlined on our website and are non-refundable once purchased.
    • One-time packages are charged once for the chosen duration.
    • Member packages are billed on a recurring basis according to the chosen tier.
    • You are responsible for maintaining accurate and up-to-date payment information.
    • ARC reserves the right to change membership fees or plans at any time, with reasonable notice provided to members.
    • Billing Exception: If your billing cycle falls on the 18th, 19th, or 20th of any given month, you will be charged on the 17th instead. This is to give you sufficient time to sort out your payment and ensure eligibility for the upcoming monthly free giveaway.

    5. Entries into ARC Promotional Draws

      a. One-Off Membership Entries

      • If you purchase a one-time package through a link specifically advertised for an ARC promotion during the promotion period, you’ll receive the designated number of entries for that promotion as part of your package.
      • One-time packages purchased through promotional links grant entries for that specific promotion only.

      b. Ongoing Membership Entries

      • Ongoing memberships automatically provide access to entries for all ARC member–only promotions, as outlined in your membership tier benefits.

      c. Repeat Winner Restriction

      To ensure fairness, any member who has been selected as a Winner in an ARC giveaway shall not be eligible to win another giveaway for a period of ten (10) months from the date of the initial win. Such members may still participate in promotions, but any entries received during the exclusion period will be deemed ineligible for prize selection.

        d. Entry Adjustments

        ARC reserves the right, at its sole discretion, to adjust, amend, or cancel entries where necessary to correct technical or human errors, or to issue entry adjustments as compensation or goodwill. Any such action shall be taken in a fair and transparent manner and may include, but is not limited to, the transfer of entries to subsequent promotions or redrawing affected entries.

          e. Ineligibility Clause – Promoter Affiliates

          Employees of the Promoter and any member of their immediate family (defined as a spouse, de facto partner, child, or sibling) are ineligible to enter or win any prizes in this Competition.

            f. Re-run or Entry Carry-Over

            In circumstances where a giveaway is impacted by unforeseen events, including but not limited to system failure, entry discrepancies, or force majeure, ARC reserves the right to either

            (a) Re-run the affected giveaway using existing valid entries; or

            (b) Transfer valid entries into a future giveaway of equivalent value.

            Such decisions will be made in good faith and communicated to affected members.

              General Terms

              • All entries into promotional draws are subject to individual terms and conditions associated with each specific promotion.
              • Please review those terms and conditions in conjunction with these membership terms and conditions for full details and eligibility requirements.

              6. Termination and Cancellation

                a. Cancellation by You

                • You may cancel your membership at any time through your account settings on the ARC website.
                • Upon cancellation, all access to the Service and member benefits will be disabled at the end of your current billing period.
                • No refunds will be provided for the remaining period of your membership.

                b. Termination by ARC

                • ARC may terminate your membership for any reason, including violation of these Terms, non-payment of fees, or inactivity.
                • Upon termination, all access to the Service and member benefits will be disabled.

                8. Intellectual Property

                • All content and materials on the ARC website and related services were protected by intellectual property laws, including copyright, trademarks, and patents.
                • You may not use any of the ARC content or materials without prior written permission.

                9. Use of Site and Service

                You agree not to:

                • Use the Site or Service for any unlawful purpose.
                • Attempt to gain unauthorized access to any part of the site or service.
                • Interfere with or disrupt the Site or Service or servers or networks connected to the Site or Service.
                • Use any automated means to access the Site or Service.

                10. Third Party Services and Links

                • The Site may contain links to the third-party websites or services that are not owned or controlled by ARC.
                • ARC has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.
                • ARC does not endorse any third-party websites or services.

                11. Disclaimer and Limitation of Liability

                • ARC makes no warranties or representations regarding the Service, including its accuracy, completeness, or reliability.
                • ARC will not be liable for any damages arising from your use of the Service, including but not limited to indirect, incidental, or consequential damages.

                12. Governing Law and Dispute Resolution

                • These Terms will be governed by and construed in accordance with the laws of Australia.
                • Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of the Australian Commercial Arbitration Centre.

                13. Amendments

                • ARC reserves the right to amend these Terms at any time by posting the amended Terms on the website.
                • Your continued use of the Service after the posting of amended Terms continues your acceptance of the amendments.
