Terms and Conditions

Welcome to Australian Rewards Club (referred to as "ARC", "we", "us", or "our"). By accessing or using our website, services, or proceeding with a purchase, you agree to be bound by these Terms and Conditions (Terms). Please read them carefully.

If you do not agree to these Terms, you must not access or use the website, create an account, purchase any package, participate in any competition-linked service, or use the Cashback Rewards Program.

1. Company Information

2. Eligibility

To become a member of ARC, purchase a package, participate in ARC services, or participate in any ARC promotion, giveaway, draw or competition-linked service, you must:

  • (a) Be at least 18 years old
  • (b) Be a legal resident of Australia
  • (c) Agree to comply with these Terms and all applicable laws and regulations

Exclusions:

ARC offers are available to residents of all Australian states and territories. However, residents of the Australian Capital Territory (ACT) and South Australia (SA) are ineligible to win or enter prize competitions or giveaways due to applicable permit restrictions. It is the sole responsibility of the customer to consult their respective state or territory's eligibility requirements prior to making a purchase. By proceeding with a purchase, the customer acknowledges that they have read, understood, and accepted these terms, and confirms their eligibility to participate.

3. Membership Types

ARC offers three types of packages:

3.1. Major Giveaway One-Time Packages:

  • (a) Single purchase providing free entries into the monthly Major Giveaway Competition only;
  • (b) Access to the Cashback Rewards Program;
  • (c) Entries credited immediately upon payment;
  • (d) Valid for current Major Giveaway period only; and
  • (e) Do not provide entries into Mini Draws.

3.2. Mini Draw One-Time Packages:

  • (a) Single purchase providing free entries into specific Mini Draw Competitions only;
  • (b) Access to the Cashback Rewards Program;
  • (c) Entries credited immediately upon payment;
  • (d) Valid for the specific Mini Draw designated at purchase only;
  • (e) Do not provide entries into Major Giveaways; and
  • (f) Clearly labelled as "Mini Draw" at the time of purchase on the website and in the confirmation email.

3.3. Member Packages (Monthly Subscription):

  • (a) Recurring monthly billing (Silver, Gold, Platinum tiers);
  • (b) Provide member entries into both monthly Major Giveaway Competitions and Mini Draw Competitions that can accumulate for the term of your Member Package;
  • (c) Ongoing access to the Cashback Rewards Program; and
  • (d) "Per giveaway" means per calendar month.

Package Details: Entry numbers, pricing, and benefits for each package type are displayed on the website at the time of purchase and confirmed via email.

Important: Major Giveaway One-Time Packages and Mini Draw One-Time Packages are competition-specific. One-Time Package entries do not transfer between competition types. Member Package entries apply to both Major Giveaway and Mini Draw competitions. Purchase confirmations clearly specify which competition type applies.

4. Membership Fees and Billing

  • (a) Membership fees are outlined on our website and are non-refundable once purchased.
  • (b) One-Time Packages are charged once for the chosen duration.
  • (c) Member Packages are billed on a recurring basis according to the chosen tier.
  • (d) You are responsible for maintaining accurate and up-to-date payment information.
  • (e) ARC reserves the right to change membership fees or plans at any time, with reasonable notice provided to members.

Billing Exception: If your billing cycle falls on the 18th, 19th, or 20th of any given month, you will be charged on the 17th instead. This is to give you sufficient time to sort out your payment and ensure eligibility for the upcoming monthly free giveaway.

Non-Excludable Rights: Nothing in this section limits, excludes, restricts or modifies any consumer guarantee, right, remedy or other entitlement that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law in Schedule 2 to that Act.

4.1. PayTo Mandates and Recurring Payments

If you select a Member Package and elect to pay via PayTo, the following terms apply:

  • (a) You authorise ARC to establish a PayTo Mandate (Mandate) with your financial institution in connection with your chosen membership tier.
  • (b) You must log in to your nominated financial institution's mobile banking app or internet banking portal to review and authorise the Mandate before your subscription can be activated and eligible entries allocated.
  • (c) Once authorised, the Mandate allows us to initiate recurring debits from your nominated bank account in accordance with your billing cycle.
  • (d) You may amend, pause, or cancel your Mandate at any time through your financial institution or by contacting us. However, you acknowledge that cancelling or pausing your Mandate does not automatically cancel your Member Package contract or your obligation to pay outstanding membership fees. If a Mandate is cancelled or paused, you must immediately provide an alternative payment method to maintain your active membership and entry eligibility.
  • (e) If a transaction initiated under a Mandate fails or is dishonoured due to insufficient funds or account issues, we reserve the right to re-present the debit in accordance with payment network rules, or suspend your membership in accordance with section 5.10.

5. Competition Entries

5.1. Entry Allocation:

Entries are allocated by package type as follows:

  • (a) Major Giveaway One-Time Packages: Entries for current Major Giveaway only.
  • (b) Mini Draw One-Time Packages: Entries for designated Mini Draw only.
  • (c) Member Packages: Monthly member entries apply to both Major Giveaway and Mini Draw competitions.
  • (d) Bonus entries: bonus entries may be offered via promotions, coupons, referrals, or free entry methods.

5.2. Entry Limits:

Entry limits are specified in each competition's terms and conditions.

5.3. Entry Validity:

  • (a) Member Package entries are carried forward from month to month as long as the subscription remains active, subject to these Terms and the relevant competition-specific terms.
  • (b) One-Time Package entries (both Major Giveaway and Mini Draw) do not carry forward and are valid only for the specific competition designated at the time of purchase.
  • (c) Upon membership cancellation or suspension part-way through a billing cycle, the entries already credited will remain valid for upcoming draws or giveaways held during the remainder of that current billing cycle only. However, no further entries will be credited after the end of that relevant billing cycle, and for the avoidance of doubt, after the membership period ends.
  • (d) Suspended memberships may be eligible for entry restoration upon reactivation in accordance with section 5.10.
  • (e) Nothing in this section prevents ARC from voiding, removing, reversing or adjusting entries where permitted by these Terms, the relevant competition-specific terms, or applicable law, including where entries were obtained through error, fraud, duplicate accounts, payment failure, breach or misuse.

5.4. Repeat Winner Restriction:

  • (a) First Prize Winners cannot win another ARC giveaway for 10 months from the date of the relevant winning draw.
  • (b) During this 10-month exclusion period, First Prize Winners may continue to hold an active membership and eligible entries still continue to accumulate. However, the eligible entries will not be entered into any giveaway or prize draw during that period.
  • (c) Cashback offers remain available during this exclusion period, unless otherwise stated in these Terms, the relevant package terms, or any applicable promotion terms.

5.5. Employee and Family Exclusion:

ARC employees and immediate family (spouse, de facto partner, child, sibling) are ineligible to participate in any draws / giveaways.

5.6. Entry Adjustments:

  • (a) ARC may adjust entries to correct administrative, technical, system, processing, payment or allocation errors.
  • (b) ARC may also provide compensatory entries where ARC considers it appropriate (acting in its absolute discretion), subject to any applicable competition-specific terms and permit requirements.
  • (c) Where feasible, errors are rectified rather than entries cancelled.

5.7. Competition Disruption:

If competition is impacted by system failure or force majeure or another event beyond ARC's reasonable control, ARC may re-run using existing entries, transfer entries to equivalent future competition or take any other action permitted by the relevant competition-specific terms and applicable law.

5.8. Competition-Specific Terms:

  • (a) Each competition has separate terms and conditions.
  • (b) ARC customers must review each competition's specific terms in addition to these general terms.
  • (c) If there is any inconsistency between these Terms and the competition-specific terms for a particular competition, the competition-specific terms prevail to the extent of the inconsistency (for that competition only).

5.9. Technical Failures and Notification Delays:

ARC is not liable for delays or failures in sending notifications, communications, or promotional messages due to technical issues, system failures, or third-party service provider disruptions. Reasonable efforts will be made to rectify issues and communicate with affected members. Members should contact support@australianrewardsclub.com.au for assistance.

5.10. Entry Restoration for Re-activated Memberships:

If a Member Package subscription is suspended due to payment failure and later reactivated:

  • (a) Member entries during suspension may be restored at ARC's discretion;
  • (b) Subject to payment verification and account standing;
  • (c) Requests for restoration must be made within 7 days of reactivation;
  • (d) Applies only to standard monthly member entries (not promotional);
  • (e) One-Time Package entries are not eligible for restoration; and
  • (f) ARC may decline restoration in cases of repeated payment failure, fraud, or abuse.

6. Cashback Rewards Program

6.1. Earning Cashback Rewards

Cashback Reward means the specified percentage of a purchase amount that is credited to a member's account when making an eligible purchase.

Members of ARC may earn Cashback Rewards on qualifying purchases made from participating retail stores accessed exclusively through the ARC platform (the Cashback Rewards Program).

Cashback Rewards are earned when a member clicks through a cashback-enabled link on the ARC website or application and completes a qualifying purchase at a participating store.

The value of the Cashback Reward will vary depending on the participating store and the applicable rate displayed at the time of the transaction.

For the purposes of these Terms, "Cashback Access Level" means the cashback benefit level, rate, entitlement, access period, or promotional cashback benefit attached to a particular ARC package, membership tier, One-Time Package, promotional offer, or other cashback-enabled product made available through the ARC platform.

"One-Time Package Promotional Period" means the period during which a Cashback Access Level attached to a One-Time Package is stated to apply, as displayed on the ARC platform at the time of purchase or confirmed to the member by email.

6.2. Eligibility for Cashback Rewards

To be eligible to earn Cashback Reward, members must:

  • (a) access the participating store via the ARC platform using the designated cashback tracking links;
  • (b) complete a qualifying purchase in accordance with the participating store's terms and conditions;
  • (c) ensure that cookies and tracking are enabled on their browser or device at the time of the transaction; and
  • (d) not use any coupon codes, discount codes, or promotional offers that are not expressly authorised by ARC in conjunction with the Cashback Reward offer.

It is the sole responsibility of the member to confirm their eligibility to participate in the Cashback Rewards Program prior to making any qualifying purchase.

Members who do not meet the eligibility requirements are not entitled to earn, accumulate, or withdraw cashback rewards, and any cashback credited to an ineligible member's account may be forfeited without notice.

ARC does not guarantee that cashback will be awarded on every transaction, as cashback eligibility is subject to confirmation by the participating store and compliance with applicable merchant policies.

6.3. Cashback Status Definitions

For the purposes of this Cashback Rewards Program, the following cashback status definitions apply:

  • (a) "Pending" means the cashback status indicating that an eligible Cashback Reward transaction has been registered with ARC. Pending status has not yet been confirmed by the participating store and is not yet available for withdrawal or use by the member. A pending Cashback Reward may be adjusted, reduced, or cancelled if the participating store does not confirm the transaction or if the transaction is subsequently returned, refunded, or cancelled.
  • (b) "Available" means the cashback status indicating that ARC has received confirmation and payment of the Cashback Reward from the participating store and that the Cashback Reward amount will be credited to the member's account. Once cashback reaches Available status, it is finalised and eligible for withdrawal or use in accordance with these Terms.

Members acknowledge that there may be a delay between the date of a qualifying purchase and the date that cashback moves from Pending to Available status. This delay is dependent upon the participating store's confirmation and payment processes, which are outside the control of ARC.

6.4. Withdrawing and Automatic Payment of Cashback

Members may use available Cashback that has reached Available status, as defined in section 6.3, in the following ways, subject to the terms of this section and any applicable limitations:

6.4.1. Withdrawing Cashback

  • (a) Members may request withdrawal of Available Cashback to their nominated Australian bank account, provided that:
    • (i) the withdrawal amount is at least twenty Australian dollars (AUD $20);
    • (ii) the withdrawal does not exceed the total available Cashback balance in their account; and
    • (iii) the member has provided accurate, current and valid Australian bank account details.
  • (b) Withdrawals to a valid bank account will be processed by ARC within a reasonable period after receipt of a valid request, typically within ten (10) business days, subject to verification, accurate bank account details, platform processing requirements, and compliance with any applicable banking or regulatory requirements.
  • (c) Members must provide accurate and current Australian bank account details. ARC is not responsible for any delay, failed payment, rejected payment, misdirected payment, or inability to process a withdrawal where the member has provided incomplete, inaccurate, outdated, or invalid bank account details.
  • (d) ARC reserves the right to charge administrative fees for withdrawals if notified in advance through the platform.
  • (e) Any withdrawal requests below the minimum amount of AUD $20 will not be processed, and the Cashback will remain available for future use or alternative redemption options.
  • (f) Members are not required to manually withdraw Available Cashback within any fixed timeframe unless ARC notifies the member otherwise through the platform or these Terms. However, ARC may process automatic payments in accordance with the Auto Payout provisions below.

6.4.2. Auto Payout Threshold

  • (a) If a member's Available Cashback balance reaches or exceeds nine hundred Australian dollars (AUD $900), ARC may automatically process a payout of the member's Available Cashback balance to the member's nominated Australian bank account (Auto Payout Threshold).
  • (b) The Auto Payout Threshold applies only to Cashback that has reached Available status. Pending Cashback, declined Cashback, cancelled Cashback, disputed Cashback, or Cashback that remains subject to investigation will not be counted towards the Auto Payout Threshold.
  • (c) Where a member's Available Cashback balance reaches or exceeds AUD $900, ARC may pay out the full Available Cashback balance, or such lesser amount as ARC reasonably determines is required to reduce the member's Available Cashback balance below the Auto Payout Threshold (Auto Payout).
  • (d) Auto Payouts will be processed within a reasonable period after the Available Cashback balance reaches the Auto Payout Threshold, typically within ten (10) business days, subject to verification, accurate account details, platform processing requirements, and any applicable banking or payment processing requirements.
  • (e) If a member has not provided valid Australian bank account details, ARC may be unable to process an Auto Payout. In that case, the member must promptly provide or update their Australian bank account details through the platform or by following any instructions issued by ARC. ARC is not liable for any failure to process an Auto Payout in circumstances where the member has not provided or updated its Australian bank account details through the platform or by following the instructions issued by ARC.
  • (f) ARC may delay, suspend, reverse, or decline an Auto Payout if it reasonably suspects misuse, fraud, abuse, duplicate accounts, breach of these Terms, transaction reversal, merchant adjustment, technical error, or any issue affecting the member's entitlement to receive the relevant Cashback.
  • (g) The Auto Payout Threshold does not prevent ARC from applying any other rights under these Terms, including rights relating to verification, investigation, suspension, termination, forfeiture, or adjustment of Cashback.

6.4.3. Other Uses

  • (a) In addition, subject to future implementation of this feature by ARC, members may be able to use Available Cashback to make qualifying purchases directly at other participating merchants within the Cashback Rewards Program.
  • (b) If this functionality is made available, this redemption option will allow members to apply their available Cashback as a credit towards eligible transactions at such merchants.
  • (c) Until this feature is available, members will be notified through the platform, and in the interim, Cashback may only be redeemed via bank withdrawal as outlined above.
  • (d) All Cashback redemptions under this section are subject to the member having sufficient cleared Available Cashback in their account at the time of redemption. Cashback is non-transferable, cannot be exchanged for cash equivalents outside the permitted withdrawal process, and cannot be combined or pooled across multiple member accounts.
  • (e) ARC may, at its sole discretion, vary, restrict, suspend, or decline any Cashback redemption request if it suspects misuse, fraud, abuse, or any breach of these Terms and Conditions, including but not limited to attempts to circumvent minimum thresholds or eligibility rules. In such cases, ARC may forfeit the relevant Cashback without liability and may suspend or terminate the member's access to the Cashback Rewards Program.
  • (f) Members acknowledge that all redemptions are final, and no further claims will be entertained once processed, except in cases of proven technical error by ARC. For the avoidance of doubt, pending Cashback cannot be used for any redemption until it reaches Available status.

6.4.4. Account Name Verification (Zepto Validate)

  • (a) To prevent payment redirection fraud and ensure secure processing of withdrawals, we utilise an account name matching and verification service, Zepto Validate (Confirmation of Payee), operated by our third-party payment processor, Zepto Payments Pty Ltd.
  • (b) When you provide or update your nominated Australian bank account details, this service matches the account name, BSB, and account number you have provided against the records held by your financial institution.
  • (c) You acknowledge and agree that:
    • (i) this verification service is provided on an "as is" and "as available" basis for risk mitigation purposes only;
    • (ii) neither ARC nor our third-party payment processors guarantee the accuracy, completeness, or reliability of any matching results or lookup responses;
    • (iii) you remain solely responsible for ensuring that all nominated bank account details are entered accurately; and
    • (iv) to the maximum extent permitted by law, ARC and its payment processors exclude all liability for any failed payments, delayed payouts, or losses resulting from your reliance on, or any errors in, the account verification service.

6.5. Member Obligations and Shopper Rules

By participating in the Cashback Rewards Program, members agree to the following mandatory rules:

  • (a) ARC is solely responsible for distributing Cashback Rewards to members, and members acknowledge that any third-party technology providers or affiliate networks engaged by ARC shall have no liability to members for the payment or non-payment of a Cashback Reward.
  • (b) Members acknowledge and agree that our third-party payment processors (including Zepto Payments Pty Ltd), partner financial institutions, and affiliate networks shall have no direct liability, obligation, or entitlement to members for the payment, non-payment, delay, or failure of any transaction or Cashback Reward.
  • (c) It is a violation of these Terms to create duplicate accounts. Each member is permitted to hold only one Member Package account with ARC. Multiple Member Package accounts bearing the same name, address, email address, payment details, or other identifying features may be flagged as fraudulent activity. Fraudulent activity includes, but is not limited to, engaging in a pattern of returning products after the corresponding Cashback Reward has been credited, making fraudulent referrals, and creating multiple accounts.
  • (d) Members are responsible for maintaining and protecting their password and login credentials and are fully responsible for all activities that occur using their account (login activity or otherwise). Members agree to immediately notify ARC of any unauthorised use of their account or any other breach of security, and to ensure that they log out of their account at the end of each session.

Any violation of these provisions may result in the suspension or termination of the member's account (including any duplicate accounts), together with the forfeiture of all Cashback Rewards attributable to such accounts.

ARC reserves the right to rescind any cashback, bar further Cashback Rewards, and terminate or suspend any member's account that it may, in its sole discretion, deem suspicious, abusive, unethical, fraudulent, or otherwise in violation of these Terms, merchant policies, or any applicable law.

ARC may vary, restrict, suspend or decline any Cashback redemption request if it suspects misuse, fraud, abuse or breach of these Terms, including attempts to circumvent minimum thresholds or eligibility rules. In such cases, ARC may forfeit the relevant Cashback without liability and may suspend or terminate the member's access to the Cashback Rewards Program, subject to any non-excludable rights under applicable law.

All decisions of ARC are final to the extent permitted by law, and do not limit any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

6.6. Missing Cashback Investigations

If a member believes that a Cashback Reward has not been correctly tracked or credited for a qualifying purchase, the member may submit a missing Cashback Reward claim to ARC for investigation.

Please note that factors including, but not limited to, the use of unauthorised coupon codes, failure to complete a transaction through the designated tracking link, product returns, order cancellations, or breach of merchant promotional rules may result in cashback being declined or revoked. If this is determined to be the case, any alleged missing cashback will not be credited.

Missing Cashback Reward claims (Claims) must be submitted no later than three (3) months from the date of the transaction in question. Claims submitted after this period will not be accepted, and ARC shall have no obligation to investigate or credit Cashback Rewards for such Claims.

When submitting a Claim, members must provide all relevant transaction details, including the date of purchase, the participating store name, the order number or transaction reference, and the purchase amount.

Upon receipt of a valid Claim, ARC will investigate with the relevant participating store. Members acknowledge that investigations may take up to six (6) months from the date the investigation commences. If, within this six-month period, the participating store is unable to confirm the cashback eligibility of the transaction in question and ARC receives no funds in respect of the transaction, ARC may close the investigation and the respective Claim. Members will be notified of the outcome of any investigation.

Factors including, but not limited to, the following may result in a cashback Claim being declined, revoked or not credited:

  • (a) use of unauthorised coupon codes;
  • (b) failure to complete a transaction through the designated tracking link;
  • (c) product returns;
  • (d) order cancellations;
  • (e) transaction reversals;
  • (f) breach of merchant promotional rules; or
  • (g) failure to satisfy these Terms or applicable merchant policies.

If this is determined to be the case, any alleged missing cashback will not be credited.

6.7. Cashback Access Level and Package Interaction

Where a member holds, purchases, or activates more than one ARC Member Package and One-Time Package (a total of one of each member type), promotional offer, or other cashback-enabled product at the same time, the member's applicable Cashback Access Level will be determined in accordance with this section.

6.7.1. Higher Cashback Access Level

If a member purchases a One-Time Package while an active Member Package is in place, and the Cashback Access Level included in the One-Time Package is higher than the Cashback Access Level included in the member's current Member Package, the higher Cashback Access Level will apply immediately for the duration of the One-Time Package Promotional Period.

During the One-Time Package Promotional Period, the Cashback Access Level attached to the member's active Member Package may be temporarily overridden to the extent necessary to give effect to the higher Cashback Access Level.

6.7.2. Lower or Equivalent Cashback Access Level

If a member purchases a One-Time Package while an active Member Package is in place, and the Cashback Access Level included in the One-Time Package is equal to or lower than the Cashback Access Level included in the member's current Member Package, the Cashback Access Level attached to the member's active Member Package will continue to apply during the active Member Package access period.

In that circumstance, the Cashback Access Level attached to the One-Time Package may be deferred and will only apply after the expiry or cancellation of the Member Package, or after the Member Package access period ends, whichever occurs first, provided that the One-Time Package Promotional Period or applicable access period has not otherwise expired.

This deferral includes the number of cashback access days included in your One-Time Package. The cashback access days will not run concurrently with the active Member Package access period and will be deferred. Those deferred cashback access days will only commence after the expiry or cancellation of the Member Package, or after the Member Package access period ends, whichever occurs first, provided that the One-Time Package Promotional Period or applicable access period has not otherwise expired.

For clarity, access to a higher Cashback Access Level does not extend, accelerate, or duplicate the cashback access days attached to the One-Time Package unless expressly stated.

6.7.3. Reversion

Upon expiry of the One-Time Package Promotional Period, or once any deferred One-Time Package cashback benefits have been applied or have expired, the member's Cashback Access Level will revert to the Cashback Access Level associated with their active Member Package, if any.

If the member does not hold an active Member Package at that time, the member's Cashback Access Level will revert to the level otherwise applicable to their account, package, promotional offer, or platform access, as determined by ARC.

6.7.4. No Stacking or Duplication

Unless expressly stated otherwise by ARC in writing or through the platform, Cashback Access Levels do not stack, combine, multiply, or operate cumulatively. A member is entitled to the applicable Cashback Access Level determined under this section, not multiple Cashback Access Levels for the same transaction.

Where multiple packages, memberships, or promotions could apply to the same transaction, ARC may determine which Cashback Access Level applies, provided that higher Cashback Access Level benefits will apply immediately where required under this section.

6.7.5. Platform Display and Confirmation

The Cashback Access Level applicable to a member may be displayed through the ARC platform, purchase page, member account, promotional materials, or confirmation email. If there is any inconsistency between a general description of cashback benefits and the specific Cashback Access Level displayed or confirmed at the time of purchase, ARC may determine the applicable Cashback Access Level by reference to the member's package type, purchase confirmation, active access period, and these Terms.

6A. Cancellation and Termination

6A.1. Member Package Cancellation by You:

Members may cancel anytime via account settings. Takes effect at the end of the current billing period. No refunds for the current billing period, subject to any non-excludable rights under Australian law. Entries for current draw remain valid.

Until the end of the current billing period, a cancelling member may continue to receive the Member Package access and benefits applicable to that billing period, subject to these Terms.

Entries already credited remain valid for the current billing cycle and any applicable draw or giveaway up to the end of the relevant billing cycle, subject to these Terms and the applicable competition-specific terms.

The member's Cashback Access Level will continue until the end of the current billing period, subject to any applicable deferred One-Time Package benefits and section 6.

6A.2. Termination by ARC:

ARC may terminate for breach of these Terms, fraud, duplicate accounts, misuse or abuse, or non-payment. Immediate termination for serious breach. Access is disabled upon suspension or termination. No refunds except as required by law.

ARC may also investigate, reverse benefits, void entries, adjust Cashback, decline payouts, or take other action to the extent permitted by these Terms, the relevant competition-specific terms and applicable law.

6A.3. Consequences of Termination:

Upon termination:

  • (a) access to the account, website features, package benefits and Cashback Rewards Program may cease;
  • (b) ARC may forfeit unconfirmed, Pending or improperly obtained cashback;
  • (c) ARC may retain, adjust, reverse or remove entries to the extent permitted by these Terms and the relevant competition-specific terms;
  • (d) Available Cashback may be paid, withheld, investigated, adjusted or forfeited depending on the reason for termination and the member's entitlement to that Cashback; and
  • (e) no refund is payable except to the extent required by law.

Nothing in this section limits any consumer guarantee, statutory right or remedy that cannot lawfully be excluded.

7. Intellectual Property

  • (a) All content on the ARC website and platform is owned or licensed by ARC. This includes branding, trade names, text, graphics, images, logos, software, platform materials, promotional materials and other website content.
  • (b) You must not reproduce, adapt, exploit or modify any content on the ARC website and platform without ARC's permission. Any such content is for personal, non-commercial use only.
  • (c) You grant ARC a royalty-free license for submitted content, including reviews, feedback, testimonials, images, comments or other materials, to the extent required for promotional, operational and business use.
  • (d) You must ensure that any content you submit does not infringe the rights of any third party and is not unlawful, misleading, offensive or otherwise inappropriate.

8. Acceptable Use

  • (a) No unlawful use or system tampering.
  • (b) No automated access or entry, cashback or referral manipulation.
  • (c) No multiple accounts to bypass limits.
  • (d) No fraud or interference.
  • (e) Notify ARC of unauthorised access.

9. Privacy

By accessing our website, purchasing a membership, or participating in the Cashback Rewards Program, you expressly consent to ARC disclosing your personal information (including your name, contact details, bank account details, and transaction history) to our third-party payment processor, Zepto Payments Pty Ltd (ABN 61 604 057 598) (Zepto), for the purposes of facilitating payments, processing cashback withdrawals, and conducting identity and account verification. Your personal information will be collected, held, and processed by Zepto in accordance with its own Privacy Policy, which is publicly available on its website at www.zepto.com.au.

10. Third-Party Links and Suppliers

The ARC website may contain links to third-party websites, retailers, participating stores, suppliers and service providers.

ARC is not responsible for third-party websites or suppliers except where liability cannot be excluded under Australian Consumer Law.

11. Disclaimers and Liability

Services provided "as is" without warranties. ARC not liable for indirect, incidental, or consequential damages, except where liability cannot be excluded by law.

To the fullest extent permitted by law, ARC is not liable for any indirect, incidental, special or consequential loss or damage arising out of or in connection with the website, services, packages, competitions, Cashback Rewards Program, third-party sites, tracking issues, notification delays or these Terms.

Nothing in these terms limits, excludes, or modifies consumer guarantees, rights, or remedies under the Competition and Consumer Act 2010 (Cth) or the Australian Consumer Law that cannot be lawfully excluded.

ARC's total aggregate liability to you arising out of or in connection with these Terms, the website, ARC services, packages, competitions or the Cashback Rewards Program is limited to the amount paid by you in the preceding 12 months, except where prohibited by law.

12. Responsible Participation

13. Tax

Winners are solely responsible for any tax obligations or liabilities arising in connection with prizes, cashback, rewards or other benefits, to the extent applicable. Seek independent tax advice.

14. Force Majeure

ARC is not liable for failure due to events beyond reasonable control (such as natural disasters, pandemics, government restrictions, system failures, third-party service failures, telecommunications or internet disruptions, etc.).

Where a force majeure event occurs, ARC is not liable for any delay, failure, suspension, interruption or inability to perform caused by that event.

This section operates together with section 5.9 in relation to competition disruption, failure or force majeure.

15. Governing Law and Dispute Resolution

These Terms will be governed by and construed in accordance with the laws of Victoria, Australia, except to the extent that any applicable trade promotion permit, approval, or law in another Australian State or Territory requires otherwise.

Any disputes arising out of or relating to these Terms will be resolved through binding arbitration in accordance with the rules of the Australian Commercial Arbitration Centre.

This section does not prevent ARC from taking urgent action to protect its systems, intellectual property, users, competitions, platform, accounts, Cashback Rewards Program or legal rights.

15.1. Payment and Transaction Disputes

All payment queries, transaction disputes, direct debit claims, or cashback discrepancies are strictly confidential and must be raised directly with ARC in accordance with our dispute resolution procedures. You acknowledge that our third-party payment processor, Zepto, does not manage customer service queries for ARC and has no authority to resolve disputes directly with you. You must not contact Zepto or its partner financial institutions directly regarding any transaction processed through the ARC platform.

16. Amendments

ARC may amend these Terms at any time. Amended Terms will be posted on the website and will take effect from the stated update date or another effective date specified by ARC. Continued use after posting constitutes acceptance. If a member does not agree to the amended Terms, the member must stop using ARC services and cancel any subscription before the next billing event.

17. Acknowledgment

By purchasing or using ARC services, you confirm:

  • (a) You have read and agree to these terms
  • (b) You meet eligibility requirements
  • (c) You understand Major Giveaway One-Time Packages and Mini Draw One-Time Packages are competition-specific and separate
  • (d) You understand Member Package entries apply to both Major Giveaway and Mini Draw competitions
  • (e) You are responsible for maintaining accurate contact details
