- Additional entries may be offered through promotional campaigns, referral incentives, or other offers made available during the Promotion Period. Details of such promotional offers will be published on the Promoter's Website and are subject to change with reasonable notice.
- Multiple Mini Draw One-Time Packages may be purchased to accumulate entries, subject to the maximum entry limit specified below.
- A maximum of 500,000 entries per Entrant for the duration of the Promotion Period.
Employees of the Promoter and any member of their immediate family (defined as a spouse, de facto partner, child, or sibling) are ineligible to enter or win any prizes in this Competition.
6. Membership Package Conditions:
- Entries from Mini Draw One-Time Packages are credited immediately upon successful payment.
- Entries are valid only for this specific Mini Draw and will not carry forward to any subsequent Mini Draw or the Major Draw Competition.
- Entry is only valid if the payment has been successfully processed.
- Mini Draw One-Time Package access days (for discounts and benefits) commence immediately upon purchase and run for the duration specified at the time of purchase, independent of any Member Package subscriptions.
- Once a Mini Draw One-Time Package has been purchased and entries have been allocated, no refunds will be provided except as required by law, including the Australian Consumer Law. PART C - ENTRY AND DRAW PROCEDURE
1. Method of Entry
- It is the responsibility of each Entrant to ensure they meet all eligibility requirements and purchase a valid Mini Draw One-Time Package during the Promotion Period.
- Entrants must ensure they purchase the correct One-Time Package designated for the Mini Draw Competition. Purchases of One-Time Packages designated for the Major Draw Competition will not grant entries into this Mini Draw. The Website clearly distinguishes between package types, and all purchase confirmations will specify the competition type.
- Entrants who believe they have mistakenly purchased the wrong package type should contact the Promoter within 48 hours at hello@australianrewardsclub.com.au.
- The Promoter is not liable for entries that are incomplete, invalid, or submitted by ineligible participants.
- Entrants are solely responsible for ensuring their contact details are accurate and up to date.
- Incomplete, invalid, or fraudulent entries will be disqualified.
2. Draw Procedure
- The draw will take place at 8:35 pm AEDT on 8 February 2026.
- The draw will be conducted electronically using a certified third-party random draw system (e.g., randomdraws.com.au), ensuring compliance with applicable regulatory standards.
- Winners will be selected randomly and fairly from all eligible entries received during the Promotion Period.
- The draw will be conducted at the Promoter's registered address or at such other location as approved by the relevant gaming authority.
3. Winner Notification
- Winners will be notified within seven (7) days of the draw via the phone number and email address provided at the time of entry. The Promoter will make reasonable efforts to contact Winners, including multiple contact attempts via different methods.
- The Promoter shall not be held responsible for any failure to notify the Winner due to incorrect contact details submitted by the Entrant.
- Winners will be announced publicly via the Promoter's Website and social media channels within fourteen (14) days of the draw.
4. Prize Claim and Delivery
- Prizes will be delivered within ninety (90) days of verification and confirmation of eligibility.
- Prize winners must provide valid proof of identity and Australian residency prior to delivery.
- If a prize is not claimed by a Winner within two (2) months of the draw date, and the Promoter has made reasonable efforts to contact the Winner during that period (including at least three contact attempts via different methods), the Promoter reserves the right to conduct a redraw to award the prize to a reserve winner selected in accordance with the original draw process.
- Any redraw will be conducted within three (3) months of the original draw date and will be publicly announced.
- Once the First Prize Winner has selected a prize option (cash, Harley Davidson, or Sea-Doo), and the prize has either been delivered, transferred, or payment has been submitted to the Winner's nominated account, the selection is final. No changes, substitutions, or exchanges will be permitted after this point. It is the responsibility of the Winner to confirm their choice prior to finalisation.
PART D - LIABILITY, WARRANTIES AND GENERAL
1. Liability Exclusion:
- The Promoter is not responsible for late, lost, incomplete, or misdirected entries.
- The Promoter is not liable for loss, damage, or personal injury suffered by a participant as a result of entering or winning the competition, except where such liability cannot be excluded under law (including the Australian Consumer Law).
- The Promoter does not accept responsibility for third-party supplier issues beyond its reasonable control.
- The Promoter is not responsible for any technical issues, internet connectivity problems, or payment processing delays that may affect entry into the Competition, except where such responsibility cannot be excluded by law.
2. Technical or Human Errors:
In the event of any technical malfunction, human error, or other unforeseen circumstance that impacts the allocation, processing, or selection of entries, the Promoter reserves the right, at its sole discretion, to either transfer the affected entries to an alternative promotion of equivalent value or to conduct a redraw. Any such decision shall be made in a fair and transparent manner and will be communicated to the affected Entrants accordingly. Where technically feasible, the Promoter will rectify errors rather than cancel affected entries.
3. Tax Implications Disclaimer:
The Promoter makes no representations or warranties regarding tax obligations of any Winner. Winners are solely responsible for seeking independent financial or tax advice regarding their prize. Winners should be aware that prizes may have tax implications depending on their individual circumstances.
4. No Employment Relationship:
Participation in the Competition does not create any employment, agency, or partnership relationship between the Entrant and the Promoter.
5. Consumer Guarantees:
Nothing in these Terms and Conditions limits, excludes, or modifies any rights under the Competition and Consumer Act 2010 (Cth), Australian Consumer Law, or similar legislation that cannot be excluded, restricted or modified by agreement. All guarantees, warranties, terms, and conditions implied by statute or general law, which cannot legally be excluded, apply to these Terms and Conditions.
6. Privacy and Data Use:
- By entering, Entrants consent to the collection, use and disclosure of their personal information by the Promoter for the purposes of conducting the competition and delivering prizes.
- Personal information will be handled in accordance with the Privacy Act 1988 (Cth) and the Promoter's Privacy Policy.
- Personal information may be shared with third-party providers for the purpose of fulfilling prizes, conducting the draw, or regulatory compliance.
- The Promoter's privacy policy is available on the official Website at www.australianrewardsclub.com.au.
- Personal data collected will be retained only for as long as necessary to administer the Competition, fulfil legal obligations, and manage any disputes. Thereafter, data will be securely destroyed or de-identified unless continued retention is lawfully permitted.
- Entrants may access, correct, or request deletion of their personal information by contacting the Promoter at hello@australianrewardsclub.com.au, subject to legal retention requirements.
7. Modification or Cancellation Clause:
- The Promoter encourages responsible participation in this Competition.
- Entrants should only purchase packages they can afford and should not view this Competition as a guaranteed investment or income source.
- Entrants concerned about their spending habits may contact the Promoter for information about self-exclusion options or may seek assistance from Gambling Help on 1800 858 858.
- The Promoter reserves the right to implement purchase limits, cooling-off periods, or other consumer protection measures at its discretion.
8. Modification or Cancellation Clause:
The Promoter reserves the right to vary, suspend, cancel or terminate the Competition at any time due to circumstances beyond its reasonable control, subject to applicable laws and relevant gaming authority approval where required. If the Competition is cancelled prior to the draw taking place, refunds will be offered to all Entrants. If cancelled after the draw, prizes will be awarded to declared winners. In all other circumstances, no compensation will be payable except as required by law.
9. Disqualification and Suspension
The Promoter reserves the right to disqualify any Entrant who breaches these Terms, tampers with the entry process, or submits misleading or fraudulent information. The Promoter reserves the right to audit entries and disqualify any Entrant suspected of tampering with the entry process, using automated systems or bots, engaging in fraudulent activity, or otherwise undermining the fairness or integrity of the competition. The Promoter's decision is final and no correspondence will be entered into regarding disqualification decisions.
10. Promoter’s Final Decision Clause
The Promoter reserves the right to make final determinations on any matters relating to the Competition, including but not limited to eligibility, entry validity, prize allocation, and disqualification, subject to any applicable regulatory oversight. The Promoter will exercise this discretion reasonably and in good faith.
11. Publicity Release
By accepting a prize, Winners agree to participate in reasonable publicity activities (such as photos, interviews, or public announcements) and grant the Promoter a non-exclusive, royalty-free license to use their name, likeness, and city of residence in marketing materials, media, and promotional publications, without any additional compensation, unless prohibited by law. Winners may request that their surname not be published in full.
12. Force Majeure
The Promoter is not liable for any failure or delay in performing obligations due to events beyond its reasonable control, including but not limited to natural disasters, war, pandemic, civil unrest, or government restrictions. In such circumstances, the Promoter will make reasonable efforts to resume the Competition or provide appropriate alternatives, subject to regulatory approval.
13. Dispute Resolution Clause
Any disputes arising out of or in connection with the Competition will be handled in accordance with the laws of New South Wales. Where possible, disputes will be resolved amicably through direct communication with the Promoter. If unresolved after reasonable attempts at direct resolution, disputes may be referred to mediation before litigation. Nothing in this clause prevents a party from seeking urgent injunctive relief where necessary.
14. Relationship to Major Draw Competition:
The Mini Draw Competition operates independently from the Promoter's Major Draw Competition (the monthly major prize competition). Entries, prizes, terms, and conditions for each competition are separate and distinct. Participation in one competition does not grant automatic entry into the other. Entrants must specifically purchase the appropriate One-Time Package designated for the competition they wish to enter. The Website clearly distinguishes between package types through separate purchase pages, distinct labelling, and confirmation messaging.
15. Permit Compliance:
This Competition is conducted in accordance with all applicable state and territory gaming and trade promotion legislation. The relevant permit number will be displayed on all promotional materials once issued.
